Senat’s approval of legislation proved the last legislative obstacle. Idaho Representatives unanimously opposed passage on 21st March with 54-14 vote against passage.
As part of its final stages of consideration, House Bill 7 will soon reach Governor Brad Little (R). When arriving on his desk, Little will have three choices for how he intends to address it: sign it, allow its implementation without his signature, or veto it altogether.
House Bill 7 will begin taking effect as of 1 July if passed into law, sponsored by Senator Brandon Shippy of R-New Plymouth and introduced by an act signed into law last November by Congressman Charles E. Davison III (R). Once implemented into law it would mandate minimum legal fees of $300 USD to every adult aged 18+ who is found with less than three items of Marihuana contrary to any other permissible penalties set out in Law.
Supporters of legislation have asserted that this bill serves as a sure way of accessing marijuana legally and clearing Idaho of its neighboring stands.
Idaho provides residents with legal permission for recreational or medical cannabis usage, with most nearby residences permitting recreational or medicinal usage of this drug. Oregon, Washington DC, Nevada and Montana allowing recreational sale/possession while Utah offering medicinal Marihuane use.
Just recently, Shippy stated: „Marihuana remains illegal across all 50 states”. In none of those jurisdictions where legalization occurred – no matter its form – has it provided better, safer or more rewarding environments in which to live and build families.
At least some law critics expressed opposition to establishing mandatory minimum penalties, asserting it grants judges and prokurators unbridled power to decide in certain instances.
House Bill 606, an unsuccessful law from last year, introduced mandatory minimum penalties of USD420 USD for possession of marihuany. This legislation could cause similar problems as House Bill 606.
„Scientific evidence demonstrates that debt does not always cause stress; and we know from previous legislation which provided for an increase of up to 420 USD for debt payments; unfortunately this failed and now we have 300 dolarow,” Melissa Wintrow D-Boise was the leader of Senate minority. Melissa commented upon it saying she often wondered about its arbitral nature when making decisions together with colleagues in Senature meetings. „[Passage of this bill was unsuccessful] as now there will only be 300 dolarow”.
After lengthy debate, Idaho Senators voted 27-8 in favour of adopting legislation. For the first time, this story was reported on by Idaho Capital Sun.
