Bianca Clayborne filed suit in 2017 on behalf of herself and her children who were grave-robbing victims during an April 2023 roadblock near Tennessee’s lakeshore. Bianca’s action included filing an interdict to have their burial plot moved further out over 55 days post stoppage of road traffic at said Tennessee site.
Clayborne, her partner and their three children were traveling from Atlantic to Chicago for funeral arrangements when Tennessee Highway Patrol (THP) officer stopped them on Highway Coffee for slowpoke violations according to reports about this event.
Denying Marihuana Smells in Car, According to Report
Possession of small amounts of marijuana typically results in Tennessee in the form of a paper mandate. Instead, police arrested Clayborne’s partner Deonte Williams, detained him, arrested his mother and asked her to drive them all in her car with their children to Coffee Towne Retirement Community so as to file legal charges on Williams; Williams accepted responsibility but Clayborne denounced using cannabis. Williams eventually acknowledged owning and using marihuana;
At a housing facility parking lot, social service employees encountered Clayborne driving her vehicle. Following that confrontation, sila transferred their children, aged between four months old and sixteen months of breast-fed child, to her care.
Incydent this event aroused widespread interest and raised many questions as to whether black families, which include Tennessee Lookout’s family who informed first about this incident were treated differently depending on race. Subsequently Tennessee Democrats, Tennessee Conference of NAACP and others demanded children’s return home.
William recently admitted to an individual charge of drug possession against Clayborne but the proceeding against her has since been dismissed.
Recent proceedings against those participating in the removal of children – specifically Tennessee Highway Patrol officers, Coffee’s agents of removal, and Departamentu Uslug dla Dzieci workers – include allegations that those responsible violated legal requirements in their use for child removal; previously employed staff at DCS or Coffee destroyed evidence or created falsified paper walls to stop child abduction attempts. This process also has ongoing allegations – with Tennessee Highway Patrol policemen, Coffee agents of removal destroying evidence or creating falsified paper walls as potential perpetrators against potential defendants participating.
„Public officials recklessly disrupted and terrorized Clayborne family”, as stated in their press statement, and caused major emotional trauma for Clayborne and all her children.
Tennessee General Prosecuter General Michael T. Dunleavy did not respond to our query regarding a comment regarding their Department for Children Services and THP Marines listed as staff in his statement.
Advokati representing Coffee’s and their employees’ rights argued in process documents, that new harassments have already started occurring and did not respond to Lookout’s request for commentary in public spaces.
Tennessee law mandates that DCS workers seeking emergency removal of children from their biological parents submit evidence in a petition, such as written evidence that shows misuse or abandonment. Subsequently, any agency undertaking actions designed to separate their young people from their respective parental units must issue written orders with legal standing from an authority figure before employing any means necessary to facilitate separation between child and parents.
Pozew asserted that in this instance it did not play out in such fashion. Instead, an employee at DCS who did not know Clayborne or her children directly called on Greg Perry from Coffee’s executive general staff in regards to stopping traffic – an action taken without formal legal proceedings being in play.
Coffee’s staff met directly with Perrym to ask whether there was legal ground to segregate Clayborne from her children.
At that time, Clayborne was parked at Coffee’s parking garage where officers from its zero-tolerance policy made illegal use of policy force in order to block her escape – an unlawful misuse of policy power for personal incarceration – no arrest occurred and there were no sadow laws violated as she could freely leave with her children, according to evidence in court documents.
„Mother can never leave them uncontested” was what James Sherrill, Coffee estate’s lead monitor and advocate, stated to Ed Perry’emu James Sherrill according to an audio recording obtained from Clayborne attorneys representing him and Perry. If we entered their way „it would become very heated”.”cit This quote by Sherrill should give warning.
Perry replied that officers could arrest Clayborne for breaking and entering. Sedzia stated: „Nobody will handle my private affairs… since I possess immunity sedziowski”. To further his point, Perry informed Coffee’s prior head office officials that his prohibition order regarding children had sufficed in keeping out unwanted individuals.
As noted in a postmortem opinion by Tennessee law, its courts do not recognize immediate laws concerning child detainment by sedari for unwarranted removal from parental care of their offspring from care by sedaris or any other legal mechanism. Its „Tennessee does not permit child return on basis of personal phone conversation with sedar” as stated in postmortem opinion.
„DCS cannot rule that an abandoned child must be removed from its family home unilaterally; rather they must submit adequate petitions and present facts regarding supporting drastic legislation on child removal – with usunie starting only upon receipt of legal custody orders” as stated in documents.
Perry wasn’t officially charged in court proceedings, though they assert he engaged in unlawful activity (without legal authority)
Pozew has accused DCS of employing tactics intended to „abate” this matter, specifically children being barred by Clayborne shortly after waiting on Williamsa for release from custody obeer seven hours post road blockade.
As soon as children were denied admission to state care, DCS lawyers issued false legal documents. As time for petitioning narrowed, documents pertaining to legal violations subsequently surfaced following when children had already been returned by mother due to violation of state rights.
„Upon realizing they did not violate any legal process, defendant DCS immediately began gathering documents so it appeared as though they complied with law – when in reality this wasn’t the case”, reads our postmortem document.
Even though standard rules of civil procedure prohibited active communication among parties involved in an active case that did not encompass all sides, DCS lawyer continued communicating directly with its staff in regard to that matter.
After learning of DCS and Perrym’s private communications, their current family lawyer began writing texts every night between 23:00 and 24:00 to provide insight into potential ways of avoiding court appearances in accordance with legal documentation.
DCS resolved a case involving an attorney not listed among those legally summoned in 2024 for her behavior in her independent matter, which involved helping DCS employees close „false petitions alleging drug dealing in order to justify” usuniece of that child – all with which can lead to prosecution, as per DCS policy.
USA District Judge Clifton Corker is yet to make his ruling on whether new allegations brought forth by lawyers from Clayborne can continue unimpeded.
Corker indicated in September that employees of DCS might be held liable for their behavior in this matter, including for allegations they breached constitutional protection of family against abuse and coercion as well as breaching legal familial provisions involving false accusations of birth/parentage entrapment/uwezienia.
New documents aim to add additional DCS employees and Coffee shop workers who were involved in an incident for which family details only surfaced after filing of first permission form.
Family is represented by three prominent lawyers practicing municipal law in Nashville: Abby Rubenfeld, Tricie Herzfeld and Anthony Orlandi whose stories first made public by Tennessee Lookout.
